1.The agreement
1.1These terms of service ("Terms") are an agreement between Rykon Technologies Inc. and the Customer. They include the acceptable use policy and the data processing addendum, which form part of them. Where they conflict, the data processing addendum governs the processing of Personal Data, then these Terms, then the acceptable use policy.
1.2By creating an account or using the service you accept these Terms. If you accept them for an organisation, you confirm that you are authorised to bind it. The service is provided for business use; it is not offered to consumers acting outside their trade or profession.

3.The service
3.1Rykon Mail gives the Customer business email on domains it controls, and the tools to collect subscribers, send campaigns, automated and transactional email, and give AI agents mailboxes of their own.
3.2We may improve and change the service. We will not remove a material feature of a paid plan during a paid period without giving notice under clause 11 and, where you then end the service, refunding the unused part of any prepaid fees.
4.Accounts, Users and domains
4.1You keep sign-in details secure and are responsible for everything done through your account, including by your Users. Tell us promptly at support@rykonmail.com if you believe your account has been accessed without permission.
4.2You may add only domains you control. We verify ownership by a DNS record before a domain is configured anywhere, and may refuse or remove a domain whose ownership we cannot verify.
4.3An AI agent acts with its own key, within the rules you set for it. Messages outside those rules wait for a person on your account to approve them. You are responsible for what your agents send, as for any member of your team.
5.Customer Data
5.1As between the parties, Customer Data belongs to the Customer. You grant us a limited licence to host, store, copy, transmit and process Customer Data only as needed to provide, secure and support the service, and for no other purpose.
5.2For Personal Data in Customer Data, the Customer is the Controller and we are its Processor, as the data processing addendum sets out. You are responsible for having a lawful basis, and where required consent, for every person you email or whose data you put into the service.
5.3We do not sell Customer Data, use it for advertising, or use it to train artificial intelligence models.
6.Sending obligations
6.1You must comply with the laws that apply to your email, including the US CAN-SPAM Act, Canada’s Anti-Spam Legislation (CASL), the EU ePrivacy rules as implemented in each member state, the UK Privacy and Electronic Communications Regulations (PECR) and the GDPR. In particular, commercial email must:
- go only to people who gave their permission to receive it or with whom you have a relationship the law recognises; under CASL, express or implied consent as that Act defines them;
- identify you accurately in the sender name, address and subject line, without misleading headers;
- carry your valid postal address and a working way to unsubscribe; and
- honour every unsubscribe promptly, and in any case within the time the law requires (10 business days under CAN-SPAM and CASL).
6.2Rykon Mail helps you meet these duties: every campaign and automated email carries your postal address and a one-click unsubscribe that takes effect immediately, and unsubscribed, bounced and complaining addresses are suppressed for you. These tools do not shift your legal responsibility to us.
6.3Transactional email sent through the API must be genuinely transactional (account, security, receipt or order messages). It must not be used to send marketing to people who have not agreed to receive it.
7.Limits and protection of the service
7.1Sending has limits by plan. To protect every customer’s delivery, sending stops automatically for an account whose bounce or complaint rate reaches the levels at which mailbox providers would penalise the service; receiving and reading mail continue. Our staff resume sending after review.
7.2We may suspend sending, or an account, where needed to stop abuse, protect the service or other customers, or comply with the law. We will tell you why, and what is needed to resume, unless the law prevents it.
8.Plans, trials and fees
8.1Trial accounts have the limits shown in the console and may be ended by either party at any time. Paid plans are billed in advance as stated at the time of purchase, through our payment processor. Fees exclude taxes, which are added where the law requires.
8.2If a payment fails we will tell you and give you a reasonable time to fix it before limiting the account.
9.Term, closing an account and your data
9.1These Terms apply while you have an account. You may close your account at any time from Settings in the console. It closes seven days after you ask; until then everything keeps working and you may cancel the request.
9.2Before closing, move your mail out over IMAP and download your account data and contacts from the console. When the account closes, mailboxes and the mail in them, domain configuration, contacts, campaigns, automations and agents are deleted from the live service. Encrypted backups expire as the privacy policy describes. The audit log and billing records are kept as records of what happened.
9.3We may end the service for a serious or repeated breach of these Terms or the acceptable use policy, or, for any other reason, with 30 days’ notice and a refund of prepaid fees for the unused period.
10.Availability and support
10.1We work to keep Rykon Mail running and your mail safe, publish our current status and planned maintenance on the status page, and answer support requests sent from the console or to support@rykonmail.com. We do not commit to a specific uptime percentage until we have measured one we can stand behind.
11.Changes to these Terms
11.1We will give at least 30 days’ notice by email and on this page before a price change for your plan, or a material change to these Terms, takes effect. Continuing to use the service after that date is acceptance. If you do not accept a change, you may close your account before it takes effect.
12.Warranties and disclaimers
12.1Each party confirms it has the authority to enter into these Terms. We will provide the service with reasonable skill and care. Except as stated in these Terms, and to the extent the law allows, the service is provided as is, and we make no other warranty, including of merchantability, fitness for a particular purpose or uninterrupted operation. We do not guarantee that any particular message will be delivered to an inbox, since mailbox providers decide that.
13.Limitation of liability
13.1Neither party is liable to the other for indirect, special or consequential loss, or for loss of profit, revenue or goodwill. Each party’s total liability arising out of or in connection with these Terms in any twelve month period is limited to the fees the Customer paid us in that period.
13.2Nothing in these Terms limits liability for fraud, for death or personal injury caused by negligence, for the Customer’s obligation to pay fees, or any other liability that cannot be limited by law.
14.Your responsibility for your mail
14.1The Customer will defend and indemnify us against third-party claims arising from mail it or its Users send, or from Customer Data it had no right to use, in breach of these Terms or the law.
15.General
15.1Neither party is responsible for failure caused by events beyond its reasonable control. Neither party may assign these Terms without the other’s consent, except to a successor of its business. If any part of these Terms is unenforceable, the rest remains in force. These Terms are the whole agreement between the parties about the service.
16.Contact
16.1Questions about these Terms: support@rykonmail.com. Reports of abuse from a Rykon Mail sender: abuse@rykonmail.com.
